CALISTO STAYS TERMS & CONDITIONS FOR GUESTS

PinkTree Capital, headquartered at Pedro Clisante 73, El Batey, Sosua, Dominican Republic 57000, with RNC number 132-08055-6 and registered to do business in Spain with VAT number N-0251577C and the European Union under the One Stop Shop protocol, is the owner of Calisto Stays, its website, its domain, and its services.

These Terms & Conditions ("Agreement") outline the terms governing the use of Calisto Stays properties by guests ("Guest," "you," or "your"). By making a booking, you accept and agree to these terms.

RESERVATION AGREEMENT

1.1 By completing a reservation, you enter into a legally binding Rental Agreement consisting of two separate but inseparable contracts:

a. Accommodation Contract: A contract between you ("Guest") and the registered Owner of the property ("Owner"), granting the Guest the right to occupy the property for the duration of the reserved stay.

b. Service Contract: A separate contract between you ("Guest") and PinkTree Capital, covering cleaning and related services provided during your stay.

1.2 By completing this reservation, you consent to both contracts.

1.3 The Rental Agreement governs the use of the reserved property ("Property") for the specified rental period, subject to the terms outlined in these Terms & Conditions. Failure to comply with these terms may result in immediate termination of the agreement without refund.

OCCUPANCY

2.1 The maximum occupancy is two (2) persons per bedroom unless otherwise agreed in advance.

2.2 Unauthorized guests or exceeding occupancy limits may result in additional fees or immediate termination of your stay without a refund. If unauthorized occupancy is discovered, Calisto reserves the right to remove the unauthorized guests or terminate the reservation.

CHECK-IN & CHECKOUT TIMES

3.1 Check-In: After 4:00 PM.

3.2 Check-Out: By 11:00 AM.

3.3 Early check-in or late check-out may be purchased at least 24 hours in advance through Calisto Guest Services, subject to availability.

3.4 Unauthorized late check-outs will be charged at a rate of 200% of the fees charged by Calisto Guest Services a standard late checkout.

PROPERTY CONDITION & CLEANING

4.1 The property is thoroughly cleaned and prepared prior to your arrival.

4.2 If you find the property is not in satisfactory condition upon check-in, you must notify your Calisto Concierge immediately. Failure to notify us promptly will constitute acceptance of the property's condition.

4.3 Additional cleaning services are not included with your booking. However, extra cleaning services, including mid-stay cleanings, may be purchased through Calisto Guest Services.

4.4 The property is provided in 'as is' condition. While Calisto Stays will make every reasonable effort to ensure the functionality of all amenities, the Guest acknowledges that temporary issues such as internet outages, utility disruptions, or delays caused by external providers may occur, for which Calisto Stays shall not be held liable.

GUEST RESPONSIBLITIES

5.1 Property Use: Guests must use the property for residential purposes only and maintain it in a clean and orderly condition.

5.2 Guest Registration: All guests must provide valid identification upon request and comply with any applicable local registration requirements.

5.3 Code Compliance and Fines: Guests must comply with all applicable laws, ordinances, and community regulations. Guests are solely responsible for any fines, penalties, or consequences arising from violations, including but not limited to those issued by police, municipalities, residential communities, or other authorities. For example, noise complaints, improper trash disposal, or violations of parking regulations may result in fines, which will be charged to the payment method on file.

5.4 No Pets Policy: Pets are strictly prohibited unless explicitly authorized in writing. Violation of this policy may result in immediate termination of your stay and additional fees to cover cleaning or damages.

5.5 Damages and Excess Cleaning Fees: Guests are responsible for the cost of any damages, missing items, or excessive cleaning required after their stay. Fees for such costs will be charged to the payment method on file.

CANCELLATION AND REFUND POLICY

6.1. Guest-Initiated Cancellations: 

For cancellations made 30 days or more before the check-in date, you may request a refund by contacting your Calisto Concierge. Refunds will be processed within 14 business days of receiving the request. Refunds are not available for cancellations made less than 30 days before the check-in date.

6.2. Refunds may also be issued as travel credits at Calisto’s sole discretion.

6.3. Force Majeure: No refunds will be issued for cancellations due to natural disasters, emergencies, or other events outside Calisto’s control. Guests are strongly encouraged to purchase travel insurance to protect against such events.

PAYMENT TERMS

7.1. Booking Payments: A 50% deposit is required at the time of booking, with the balance due 30 days before your arrival.

7.2. Calisto Guest Services Payments: Services such as early check-in, late check-out, or additional cleaning must be paid in full at the time of booking the service.

7.3. Additional Fees: Any additional fees incurred during the stay (e.g., damages, fines, or extra cleaning) will be charged to the payment method on file.

LIABILITY AND RELEASE

8.1. Calisto Stays is not liable for loss, theft, or damage to personal belongings during your stay, including but not limited to losses caused by third-party service providers such as utility companies or internet providers."

8.2. Guests assume full responsibility for their actions and agree to indemnify and hold harmless Calisto, its employees, and property owners from any claims, damages, or liabilities arising from their use of the property.

ENTRY AND INSPECTION

9.1. Calisto reserves the right to access the property for maintenance, inspections, or emergencies. Advance notice will be provided unless immediate entry is required.

FORCE MAJEURE

10.1. Calisto Stays is not responsible for cancellations or disruptions due to catastrophic events (e.g., hurricanes, pandemics, earthquakes, or other natural disasters). Guests are encouraged to purchase travel insurance to cover such events.

ASSIGNMENT AND SUBLETTING

11.1. Guests may not assign or sublet the property or allow unauthorized occupants during their stay.

GDPR AND PRIVACY POLICY

12.1. Calisto Stays complies with the General Data Protection Regulation (GDPR).

DISPUTE RESOLUTION

13.1. All disputes arising under these Terms & Conditions shall be governed by the laws of the Dominican Republic.

13.2. The courts of the Dominican Republic shall have exclusive jurisdiction to hear and settle such disputes.

ENTIRE AGREEMENT

14.1. These Terms & Conditions represent the entire agreement between the Guest and Calisto.

14.2. Any amendments must be made in writing and signed by both parties.

DEFAULT

15.1. If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings, and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made. Failure to comply may result in legal action to recover damages or outstanding amounts owed. If any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
